Terms & Conditions.

1. Nature of the Service

Elah is an AI-assisted practitioner workspace and transformation intelligence system designed primarily for hypnotherapists, NLP practitioners, coaches and other transformational mind-body practitioners.

Features may include:

• conversational AI Intake;
• practitioner-led assessment;
• case organization and Case Journal tools;
• progress tracking;
• Signals Fusion Reports;
• session preparation and workflow tools;
• script and practitioner content creation;
• Follow Ups;
• community and practitioner resources;
• supported third-party integrations.

Elah is not a CRM, electronic medical record system or autonomous clinical care platform.

2. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Access is personal to the licensed user or organization and may not be transferred, resold or shared in a manner that bypasses subscription or seat requirements.

3. Practitioner Responsibility

Elah provides practitioner support, information, organization and assistive intelligence. It does not replace professional judgment.

Practitioners remain responsible for:

• their professional services and conduct;
• their interactions with clients;
• working within their training and scope;
• obtaining appropriate consent;
• protecting client confidentiality;
• reviewing AI-generated information;
• determining how platform outputs are interpreted and used;
• complying with laws and professional requirements applicable to their work.

4. Client Information and Privacy

Elah is designed to minimize unnecessary client identity exposure.

Client case workflows do not require storing client email addresses, phone numbers or last names. Cases are organized around secure case references, with limited identifying information used where necessary for practitioner context.

Practitioners agree not to use Elah as a substitute repository for formal medical records, clinical records, financial information or unnecessary personally identifying information.

5. AI Processing and Outputs

Elah uses artificial intelligence and related technologies to assist with intake, analysis, content generation, organization and practitioner workflows.

AI systems can produce inaccurate, incomplete or inappropriate information.

All AI-generated summaries, analyses, suggestions, scripts and other outputs are assistive. Practitioners are responsible for reviewing outputs and deciding whether and how they should be used.

Client information submitted to Elah is not used to train Elah's underlying AI models.

6. Intended and Prohibited Use

Elah may be used to support practitioner workflows involving personal development, behavioral change, performance, mindset, coaching and other appropriate transformational work within the practitioner's scope.

Elah may not be used as an autonomous system for:

• medical or psychological diagnosis;
• psychiatric treatment;
• crisis or emergency intervention;
• autonomous high-risk psychological treatment;
• unlawful, abusive, exploitative or deceptive conduct.

Use of Elah is also governed by the Acceptable Use Policy.

7. Open Case Program

Where Elah makes an Open Case or similar practitioner referral program available, participants acknowledge:

• contributions made through the intake program support operation of the program and are not payment for professional practitioner services;
• completion of an intake does not guarantee that a practitioner will accept the case;
• participating practitioners are independent professionals and are not employees or agents of Elah;
• professional fees, scheduling and services are arranged directly between the client and accepting practitioner;
• participating practitioners may require a minimum initial-session fee disclosed as part of the applicable program;
• an anonymized or minimized case summary may be made available to eligible participating practitioners for consideration;
• client contact information will not be released to a practitioner through the program until the applicable acceptance process is completed.

8. Subscriptions and Billing

Paid access to Elah is billed according to the plan, billing interval and price displayed at purchase.

Unless otherwise stated, subscriptions automatically renew until canceled.

You may cancel future renewal in accordance with the cancellation options provided through your account or billing process.

Except where an express written satisfaction guarantee, refund policy or applicable law provides otherwise, fees are non-refundable and partial billing periods are not refunded.

Pricing may change prospectively for new purchases or subscriptions. Where Elah expressly promises that a subscription rate will remain locked while continuously active, that stated commitment will apply to the eligible subscription.

9. New Practitioner Rate

Discounted New Practitioner access may be available to eligible practitioners based on certification date and verification requirements.

Elah may request documentation reasonably necessary to verify eligibility. Providing false or misleading eligibility information may result in removal of the discounted rate or account termination.

10. White Label AI Intake

White Label AI Intake is licensed separately from the standard practitioner subscription.

White Label deployments may include a branded intake environment, custom subdomain, practitioner seats, compatible voice configuration and configured client journeys.

White Label licensing does not include source-code distribution, tenant creation, sublicensing or reseller rights unless expressly stated in a separate written agreement.

Additional terms contained in an executed White Label agreement will control where they conflict with these general Terms.

11. Practitioner Content and Platform Intellectual Property

You retain your rights in original content you create and submit to Elah, subject to the limited permissions needed for Elah to process, store and display that content in order to provide the Service.

Elah's software, interfaces, systems, protected templates, platform architecture, branding and proprietary technology remain the property of Hypnosis Near Me LLC or its licensors.

You may not copy, resell, distribute, reverse engineer or commercially exploit protected Elah technology except where expressly permitted in writing.

12. Third-Party Services and Integrations

Elah may connect with external services selected or authorized by the user.

Connected providers remain responsible for their own platforms, data, availability and terms. Unless expressly stated otherwise, the connected provider remains the system of record for information maintained by that provider.

Elah is not responsible for third-party service failures, changes, security incidents or actions outside Elah's reasonable control.

13. No Outcome Guarantee

Elah does not guarantee client improvement, behavioral change, practitioner revenue, business performance, therapeutic results or any particular outcome.

Outcomes depend on practitioner conduct, client participation and factors outside Elah's control.

14. Service Availability and Changes

Elah is an evolving platform. Features, integrations, workflows and interfaces may change over time.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by law.

Elah does not guarantee uninterrupted, error-free or permanently available operation.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Elah shall not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Service.

Elah is not responsible for practitioner decisions, practitioner misconduct, client outcomes or misuse of the platform.

To the maximum extent permitted by law, Elah's aggregate liability arising from the Service shall not exceed the greater of:

• the amount paid by the user to Elah during the three months immediately preceding the event giving rise to the claim; or
• $100 USD.

16. Suspension and Termination

Elah may suspend or terminate access where reasonably necessary because of:

• violation of these Terms or the Acceptable Use Policy;
• fraud or unlawful activity;
• security risk;
• non-payment;
• material misuse of the Service.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by applicable law, disputes arising from these Terms or the Service shall be brought in the appropriate courts located in Los Angeles County, California.

18. Changes to These Terms

Elah may update these Terms as the Service, business or legal environment changes.

Materially revised Terms will be published on Elah.io with an updated revision date. Continued use of the Service after revised Terms become effective constitutes acceptance where permitted by law.
